Salazar, the Court ruled 8-1 that Colorado’s law banning licensed counselors from providing talk therapy aimed at changing a minor’s sexual orientation or gender identity violates the First Amendment (viewpoint discrimination against speech). Justice Jackson was the lone dissenter. She argued the ban regulates professional conduct/medical treatment (not core speech), falls under the state’s authority to protect public health, and that the majority’s approach risks undermining states’ ability to regulate potentially harmful medical practices. She read her dissent from the bench, emphasizing risks like increased shame, anxiety, and suicidality among minors.
